The services of the community platform can be used in different ways. These Terms and Conditions contain the rules that apply mutually. What are your rights if you are or become a member of the community platform and what can you expect from us and what can we expect from you?

Effective date 1 June 2020

ICTRecht reserves the right to make changes to these Terms and Conditions. Changes will be published on our website. Therefore, check these Terms and Conditions regularly, so that you are aware of any changes.

  1. Definitions
  • Infoland = the organization behind the community platform.
  • User = every natural person who uses the community platform. Making use also includes only taking in information.
  • Registered user (user) = a user who has registered a username through registration. These users have their own community account.
  • Cookie = a small piece of information that is stored on the computer in the form of a file. This allows us to recognize your computer on a subsequent visit. The cookies do not remember any personal information. We specifically require your permission to use cookies. Consult the Privacy statement for more information about the use of cookies.
  1. General
  1. The community platform (including all components) is an Infoland service. The use of the community platform is free for both customers and prospects of Infoland.
  2. If you want to contribute to the Infoland Community, you must register as a user. Non-registered users can use the platform as a reader.
  3. When using the community platform, the user explicitly agrees to all terms and conditions in this document.
  4. There are no costs associated with participation of the community platform.
  5. The user must at all times adhere to the so-called "netiquette": the general rules of decency and interaction of the internet. Furthermore, the user must have taken note of - and adhere to - the general terms and conditions and the house rules that have been drawn up in the (if applicable) specific FAQs about various parts of the community platform. The user is not allowed to behave in such a way that inconvenience can arise for other users. Violation of this rule can lead to temporary or permanent denial of the entire community platform (and the associated activities).
  6. Infoland reserves the right to deny a user access to the community platform - in whole or in part and temporarily or permanently - without giving any reason. Use of the community platform services at any time during a period of denied access is NOT permitted and is subject to computer breaches by law.
  7. No rights can be derived from the community platform and its use.
  1. Registered users and registration
  1. Users are responsible for all messages, graphic and other (audio) visual expressions, links and other posted matters and actions performed through the account linked to his / her username and password.
  2. The user must handle the account made available to him / her carefully and is responsible for the misuse of his / her account by third parties, unless there is gross negligence of Infoland.
  3. The user is legally liable if he / she attempts to gain unauthorized access to closed parts of the community platform or its services and / or systems, or if the user sabotages the community platform through defacing, (D) DoS attacks and other forms of computer crime.
  4. It is not permitted to register or post an extra account if another account of the same person has been denied access to (part of) the community platform.
  1. Liability
  1. A user is fully and jointly and severally liable for all damage, direct or indirect and both tangible and intangible, resulting from actions and behavior of the user.
  2. A contribution from a participant is not read or approved by Infoland prior to placement. An opinion only reflects the opinion of the participant who places it and this opinion is not necessarily that of Infoland.
  3. Infoland is not liable for any damage, loss or other consequences that may arise from the use of the data, information, software, working methods, tools and other uses in this platform.
  4. Infoland cannot be held liable for loss or theft of data and data. Including photos, texts and other material posted by users and subscribers.
  1. Infoland rights and prohibitions
  1. Infoland expressly reserves the right to deny users access to the community platform in whole or in part and without giving any reason, for a definite or indefinite period.
  2. A user is at all times entitled to cancel his / her account without giving any reason. All data from the relevant account will then be deleted. Posts and comments posted from the account will continue to exist as they are an integral part of the discussions. However, Infoland then changes the user from a registered user to an anonymous user.
  3. If the user has been denied access, a request can be made to the community platform to cancel the account. Infoland will then carry out these actions for the user.
  4. Infoland reserves the express right to change, distribute or delete the design and / or content of messages, comments or any other form of content posted by users. In addition, Infoland can add or remove features and other software options at any time.
  5. The user grants, by placing or making available in any way messages, texts, photos and other (audio) visual material (including placing hyperlinks to the aforementioned material), an unlimited, unconditional, non-exclusive right of use for commercial and non-commercial purposes of the messages, photos and other (audio) visual material posted by the user. This includes citing (quotes) the entire material or parts thereof in other posts, displaying the entire material or parts thereof to visitors from all domains of the community platform, and any other use within the domains and subdomains of the community platform .
  6. The copyright of user-posted content remains with individual users. Infoland is not entitled to sell, rent or otherwise transfer the copyright, portrait right or any other right to the material to third parties.
  7. Offering or requesting stolen and / or otherwise legally protected or illegally obtained or obtainable material on the community platform is an immediate exclusion from all services offered by Infoland. Infoland is entitled to report a criminal offense.
  8. Abuse, in whatever form, of the community platform and the associated services can result in exclusion from the community platform, for a definite or indefinite period, without reason.
  9. As a user it is not allowed to post material on the community platform whose copyrights are not with the user or in the public domain. By posting photos, videos, texts, software, drawings, pieces of music or designs, the user declares to be the copyright holder or to have obtained his explicit permission for the use of the placed material.

  1. All rights are expressly reserved. Except downloading and printing provided information for personal use or insofar as this is explicitly indicated by Infoland, or explicit written permission is given for this, it is not permitted to copy the content of this website and its parts in whole or in part. , multiply or distribute or make public in any way. Copying news or other messages from the community platform without asking prior written permission is expressly prohibited. The copyright of the responses rests with the individual authors.
  1. Spam
  1. The use of the service, as well as the use of the information on the site, is only permitted with a view to communicating, discussing with other users on the site, while the nature of the communication improves the use of the software or knowledge sharing may serve the purpose, unless otherwise indicated on site.
  2. The (unsolicited) initiation of any form of commercial communication by means of e-mail, fax, SMS, MMS, mail, the community platform private messaging, topics, posts and reactions within the community platform, the profile of the user or otherwise with users, at least directly or indirectly promoting the goods, services, companies, websites or the image of a company, organization or person, regardless of whether these products or services relate (indirectly) to the nature of the service or possible interest of a user, not be allowed.
  3. It is not allowed, without prior permission, to advertise in topics, messages, subtitles, nickname, signatures or profiles, or to recruit via pm (personal message), dm (direct message) or any other form of communication within the community platform nor initiated via Infoland.
  4. If the user acts (in part) in violation of the forfeiture of the user, as specified in this article, without further warning or notice of default and without judicial intervention being required, an immediately payable penalty of € 500 (in words five hundred euros) per event, whereby sending a non-permissible utterance to a user counts as one event.
  1. Unforeseen circumstances and final provision
  1. In cases and situations not provided for by the general terms and conditions or various provisions, the management of the community platform decides. These decisions are final. Correspondence will only take place if and for as long as the management of the community platform or Infoland deems this desirable.
  2. Infoland reserves the right to change these conditions at any time. The user is responsible for regularly reviewing these provisions.
  3. If the user does not agree with the provisions in the General Terms and Conditions, the user is not allowed to use the services of the community platform in any way.
  4. Terms and conditions placed by the users themselves, for example in posts, signatures or elsewhere, at least visible or invisible to third parties, are strictly textual for discussion and have no legal value other than textual. They are in no way an agreement and in no way create conditions. The only agreed terms and conditions between Infoland and the user are the terms and conditions as mentioned in this document.
  5. All offers, agreements, deliveries and conditions are governed exclusively by Dutch or European law. If any provision of these conditions is null and void or is nullified, the other provisions of these conditions will remain in full force and Infoland and the user will consult in order to agree new provisions to replace the invalid or nullified provisions, whereby as much the purpose and intent of the void or voided provision may be observed

These Terms and Conditions were originally drawn up in the Dutch language. The Dutch text of these Terms and Conditions shall always prevail over, whether or not certified, translations thereof.

Privacy statement

This is the privacy statement of Infoland B.V. ("Infoland", "we", "us", "our" or similar pronouns). We are located at Run 6801, 5504DW in Veldhoven. We are responsible for the processing of personal data as shown in this privacy statement.

Personal data that we process
Infoland processes your personal data because you use our services and / or because you provide this information to us. Below you will find an overview of the personal data that we have process:

  • User name
  • E-mail address
  • Organization name
  • Information about your activities on our website
  • IP-address
  • Internet browser and device type

When creating a community account, you can optionally enter the following information: Profile picture, place and job description. If you enter this information, this information will also be processed by Infoland.


Sensitive personal data
We do not intend to store data of community visitors under the age of 16 without parental or guardian consent. However, we cannot check the age and therefore recommend parents to be involved in their children's online activities. This is to prevent data from being collected without permission. If you suspect or believe that we have stored such data without permission, please contact us at avg@infoland.nl so that we can delete this data immediately.


Why do we store personal data?
Infoland processes your personal data for the following purposes:

  • To inform you about any changes to the community platform
  • For sending community newsletters
  • To email you if necessary to carry out our services
  • In order to improve our community platform and to better tailor our platform services to your preferences, we analyze the behavior of our visitors on the community platform. This is done completely anonymously.


Automated decision making
Automated decision making Infoland does not make decisions based on automated processing on matters that can have (significant) consequences for people. These are decisions that are made by computer programs or systems, without human intervention.


How long we keep personal data?
Infoland does not store your personal data longer than is strictly necessary to realize the goals for which your data is collected. Your personal data that we need for our administration or to be able to comply with legal obligations is not stored longer than required by law and required by us.


Sharing personal data with third parties
Infoland never sells your data to third parties and will only share it if necessary for the performance of a contract with you or to comply with legal obligations.

We do use Zendesk, Inc. for our support services and we use Microsoft for our CRM. Infoland remains responsible for this processing.

We will sign a data processing agreement with companies that process your data as instructed by us to ensure an equal level of security and confidentiality of your data. If this is a company from a third country in the sense of the GDPR, then we will use the standard contractual clauses en we will ensure adequate protection. Infoland remains responsible for processing in this case too.


View, adjust or delete data
You have the right to view, correct or delete your personal data. You also have the right to withdraw your consent to the data processing or to object to the processing of your personal data by Infoland and you have the right to data portability. This means that you can submit a request to us to send the personal data that we hold about you in a computer file to you or another organization mentioned by you. You can send a request for access, correction, deletion, data transfer of your personal data or request for cancellation of your consent or objection to the processing of your personal data to avg@infoland.nl. To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request. To protect you privacy, please make sure that your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and citizen service number (BSN) are made black in this copy. We will respond to your request as soon as possible, but within four weeks. How we protect personal data?
Infoland takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized modification. If you feel that your data is not properly secured or there are indications of abuse, please contact our service desk or via avg@infoland.nl


Cookies
The data that Infoland obtains from the cookies is used to analyze the community. In addition, this data is used to adjust the community as much as possible and to tailor it to the personal preferences of the user. Finally, when sending information about their products and services, Infoland may take into account the interest that the user has shown in certain pages of the Infoland internet site.

The user chooses which cookies he / she allows. Once the user has created an account, only then can the choice be indicated in the profile settings. If a user does not have an account, the settings can always be changed by deleting cookies via the internet options of the browser and then visiting the community again. Then you will be asked to choose the settings again. There are 3 settings: Basic, Normal and Complete.
